By accessing or using FOMOmeter, you agree to these Terms of Use. If you disagree, cease using FOMOmeter immediately.

References to services, applications, dashboards, APIs, alerts, widgets, modules, or features also include any substantially similar or successor functionality, whether existing now or introduced in the future.

All information provided on FOMOmeter is for general informational purposes only. Nothing in the materials and products of FOMOmeter constitutes individual financial, investment, legal, or other professional advice.

2. Acceptance of Terms of Use

By accessing FOMOmeter, you fully accept these Terms of Use.
You agree to strictly comply with all applicable local, national, and international laws and regulations.
Unauthorized use, misuse, or interference with FOMOmeter or its data will lead to immediate termination of access and possible legal actions.
Continued use of FOMOmeter constitutes a legally binding agreement equivalent to a signed contract enforceable by applicable law.

2.1. Eligibility and Accounts

You confirm that you are at least eighteen (18) years old and have full legal capacity in your jurisdiction. Minors are prohibited from using FOMOmeter. You are responsible for maintaining the confidentiality of your access credentials and for all activities under your account.

3. Limitations on the Use of FOMOmeter

FOMOmeter functions as a digital analytical and informational publication that disseminates non-personalized materials. FOMOmeter does not provide individualized investment advice and is not required to register as an investment adviser.

Your use of FOMOmeter does not create any fiduciary, advisory, client, or professional relationship with us.

FOMOmeter does not provide investment advice, financial advice, portfolio or asset management, brokerage services, or any other regulated financial activity.

All content, metrics, dashboards, analytics, insights, posts, articles, visualizations, reports, alerts, notifications, API outputs, and any other materials are provided for general informational and research purposes only.

All FOMOmeter content, metrics, indicators, software, algorithms, models, and data sets are the property of or licensed to FOMOmeter and protected by intellectual property laws.
FOMOmeter grants a limited, revocable, non-transferable, non-exclusive, and non-sublicensable license for personal, non-commercial use only.
All rights not expressly granted are reserved by FOMOmeter. No implied licenses are granted, whether by estoppel, exhaustion, or otherwise.
Use of bots, data scraping, or automated extraction methods is prohibited. Violations will result in access termination and possible legal action.
FOMOmeter may employ technical measures, including watermarks, anti-bot systems, and usage tracking, to detect and prevent unauthorized copying, distribution, or abuse.
Users are prohibited from distributing, transmitting, reselling, renting, or sharing access to FOMOmeter content, data, algorithms, or visualizations. Violations will result in immediate access termination and possible legal actions.
Unauthorized use, copying, distribution, or commercial exploitation of any content or data is prohibited.
Use of FOMOmeter content, data, or outputs for training machine learning models, automated data extraction, or similar purposes is strictly prohibited without our prior written consent.
FOMOmeter may implement technical and operational measures to detect link or content sharing, including link binding to device, IP, or session, rate limiting, and watermarking.
No public reproduction. You must not publicly reproduce, screenshot, mirror, or republish any FOMOmeter content (including dashboards, charts, scores, metrics, or insights).
Personal, non-transferable use only. Access credentials, magic links, emails containing access tokens, dashboards, insights, metrics, and any content or data obtained from FOMOmeter are provided solely for your individual use. You must not share, disclose, resell, sublicense, publish, or provide any of the foregoing to any third party without our prior written consent. Any sharing, forwarding, or redistribution of access links, tokens, or content is strictly prohibited and constitutes a material breach of these Terms of Use.

Any commercial use of content or data without our prior written consent is prohibited. To request permission for commercial use, please contact us at app@fomometer.ai.

5. Termination and Access Revocation

FOMOmeter reserves the right, at its discretion, to terminate or suspend your access without notice or explanation.
Upon termination, you must immediately cease using FOMOmeter and delete all received materials.
FOMOmeter is not liable for any loss or damage arising from such termination.

5.1. Service Availability and Access Credentials

Access to FOMOmeter may be interrupted or delayed for maintenance, updates, experiments, third-party outages, network failures, spam filters, security blocks, or anti-fraud systems. Delivery of login emails or access links is not guaranteed and may fail or be delayed. Activation of access may not be immediate. Service is provided strictly on an “as is” and “as available” basis without warranties. You are solely responsible for maintaining backup copies of your data and ensuring alternative access to your accounts and services.
FOMOmeter provides dashboards, sentiment scores, insights, milestones, and related analytics strictly for informational and research purposes. None of these elements constitute financial, investment, legal, or professional advice or recommendations. Users must not rely on any FOMOmeter output as the sole basis for investment or trading decisions.
Access to FOMOmeter may be occasionally delayed, interrupted, or unavailable due to technical maintenance, updates, testing of new features, experiments, or external service provider outages. Delivery of login emails or magic link access messages may be delayed, blocked by spam filters, or not received at all due to factors outside of our control. Such events do not constitute a failure of service and are not grounds for refunds or compensation. Service is provided strictly on an “as is” and “as available” basis.
Visual Representation. The visual appearance, design, structure, and interface of the platform as displayed on the website, in screenshots, demo versions, or promotional materials may differ from the actual platform. FOMOmeter reserves the right to modify, update, or change the visual representation or interface at any time, at its sole discretion, without prior notice. No screenshots, demo versions, promotional materials, or other visual elements create any obligation to maintain or provide a particular appearance or set of features.

6. Comprehensive Limitation of Liability

To the maximum extent permitted by law:

FOMOmeter, including all tools, services, APIs, data streams, visualizations, AI outputs, and other content, is provided solely "as is" and "as available," without any explicit or implied warranties. FOMOmeter expressly disclaims all implied warranties, including:

fitness for a particular purpose
non-infringement
data accuracy
uptime availability
system integration
meeting your expectations

FOMOmeter does not guarantee:

availability, accuracy, completeness, performance, reliability, or timeliness
uninterrupted access
error-free operation
absolute accuracy of content

Access to FOMOmeter may be interrupted, limited, delayed, or unavailable without notice and liability. Use of FOMOmeter is solely at your own risk.

FOMOmeter reserves the right to modify or discontinue any aspect of its services at any time without prior notice.

6.1. Liability Limitation

FOMOmeter, its directors, employees, agents, contractors, partners, licensors, and affiliates are not liable for any damages, including:

direct, indirect, incidental, special, consequential, punitive, or exemplary
loss of profit, data, business, reputation, business opportunities, financial losses, or emotional distress

This limitation applies to damages resulting from:

use or inability to use FOMOmeter
interruptions, inaccuracies, failures, errors, delays, or downtimes
reliance on accuracy or performance of FOMOmeter's metrics and data
errors, omissions, misinterpretations
third-party services, data providers, integrations, or tools used by FOMOmeter
effects on your equipment, software, internet connection, or data
algorithm or AI-generated outputs

This limitation of liability remains in effect even if FOMOmeter has been advised of the possibility of such damages, regardless of the legal theory, including breach of contract, negligence, strict liability, or statutory claims.

In jurisdictions where such limitations are not permitted, FOMOmeter's liability is limited to the maximum extent permitted by law.

FOMOmeter does not guarantee uninterrupted accuracy, timeliness, or completeness of any data, analytics, or insights provided. Users acknowledge that delays, errors, or inaccuracies may occur in the display of data, charts, analytics, or metrics, and such issues carry no legal effect.

6.2. Metric Specificity and User Risk

The algorithms, models, visualizations, graphs, indicators, posts, and metrics of FOMOmeter may contain errors, malfunctions, outdated data, interpretative distortions, or other inaccuracies. The user acknowledges and accepts that such distortions are possible and assumes full risk for their use.

All FOMOmeter metrics, as well as all related indicators, visualizations, algorithms, and APIs:

do not guarantee the accuracy, completeness, or timeliness of the output data
do not guarantee uninterrupted or error-free operation
do not guarantee alignment with actual results or user expectations
may malfunction, return errors, or cease functioning entirely without prior notice

All metrics, indicators, ratings, and analytics provided by FOMOmeter represent an interpretive view of data and do not claim to reflect objective truth. Any actions taken based on these materials are done at the user's sole risk.

The user bears full responsibility for verifying the received data, conducting independent analysis, and assuming all consequences of its use.

Information displayed on FOMOmeter, including dashboards, sentiment scores, and charts, may not always reflect real-time updates and can become outdated. FOMOmeter is under no obligation to update or refresh any specific data on a continuous basis.

6.3. Updates and Exclusive Legal Remedy

FOMOmeter is not obligated to update or clarify published materials.
The sole remedy for dissatisfaction is cessation of use.

6.4. Data Sources & Market Data Disclaimer

FOMOmeter may aggregate, transform, or display data obtained from third-party sources (including market data, news feeds, social signals, APIs, SDKs, crawlers, or open datasets). Such data may be delayed, incomplete, inaccurate, corrupted, misclassified, or unavailable due to provider outages or rate limits. FOMOmeter does not verify the truthfulness, accuracy, availability, timestamping, or completeness of any third-party data and assumes no responsibility for errors, omissions, delays, or interruptions. Price quotes, charts, and indicators may differ from data shown by exchanges, brokers, or other providers. You are solely responsible for validating any data before use.

In addition, all metrics, analytics, interpretations, scores, insights, and any other outputs generated or published by FOMOmeter itself may contain errors, biases, outdated information, distortions, or subjective elements. FOMOmeter does not guarantee the objectivity, accuracy, reliability, or completeness of its own data, models, or interpretations. All such materials are provided strictly “as is” for informational and research purposes only, without warranties of any kind, and must not be relied upon as the sole basis for financial or trading decisions.

6.5. Hypothetical / Backtested Performance

Any hypothetical, backtested, or simulated performance, metrics, or scenarios (including strategy scores, signals, or analytics) are provided for illustrative and research purposes only and do not represent actual trading results. Past or simulated performance is not indicative of future results. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown.

6.6. Forward-Looking Statements & No Duty to Update

Certain insights or narratives may contain forward-looking statements subject to risks and uncertainties. Actual outcomes may differ materially. FOMOmeter undertakes no obligation to update, amend, or clarify any materials or metrics, including in the event of new information, future events, or regulatory changes.

7. Indemnification by User

You agree to indemnify, defend, and hold harmless FOMOmeter and its affiliates, directors, employees, and partners from and against all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use or misuse of FOMOmeter, your violation of these Terms, or your infringement of any third-party rights.

8. Prohibited Activities

Automated access, data mining, or extraction from FOMOmeter is prohibited.
Disruptive actions, hacking, reverse engineering, or unauthorized access are strictly forbidden and may result in legal action.
Sharing credentials or access with third parties is prohibited.
Circumventing or attempting to bypass rate limits, access controls, or technical protection measures is prohibited.
Framing, mirroring, or otherwise re-publishing FOMOmeter content without prior written consent is prohibited.
Removing, obscuring, or altering watermarks, attributions, headers, metadata, usage tracking, or technical protection measures is prohibited.
Generating artificial traffic, queries, or load for the purpose of manipulating metrics or evading rate limits is prohibited.

9. Disclaimer on AI Analytics and AI-generated Content

FOMOmeter uses artificial intelligence to generate market sentiment analysis and categorize content, which may contain inaccuracies, errors, or unpredictable results.
Users bear full responsibility for independently evaluating the accuracy of such content and subsequent decisions.
FOMOmeter assumes no responsibility for user actions based on AI-generated Analytics and Content.
FOMOmeter does not continuously monitor or pre-approve AI outputs. Use of such materials is solely at your own risk.
FOMOmeter’s liability for any consequences related to AI-generated content, analytics, classifications, metrics, interpretations, or any other outputs produced by AI is null.

10. Amendments and Updates

FOMOmeter reserves the right to change these Terms of Use at any time at its sole discretion. You are responsible for periodically reviewing these Terms of Use. Continued use of FOMOmeter after changes take effect indicates acceptance of the updated Terms of Use. FOMOmeter is not obligated to provide prior notification of amendments. Continued use after updates to these Terms constitutes explicit acceptance of those changes.

11. Governing Law and Dispute Resolution

All disputes, claims, or legal proceedings arising from these Terms or Use of the platform shall be exclusively resolved by the judicial authority, jurisdiction, and under the law selected by FOMOmeter at its sole discretion at the time of dispute.
You expressly waive objections against FOMOmeter's choice, including forum inconvenience, lack of jurisdiction, or unfairness.
FOMOmeter reserves the right to demand arbitration, judicial proceedings, or other dispute resolution methods in any country, language, or legal system at its discretion.
By using the platform, you consent in advance to FOMOmeter's exclusive right to determine all procedural and substantive aspects of dispute resolution.
You waive the right to seek an injunction that could impede FOMOmeter's operation.
Users agree not to participate in any class action lawsuit against FOMOmeter.

12. Refunds and Billing

The Refund Policy available on FOMOmeter is incorporated into these Terms by reference.

General terms. This Refund Policy governs your access to and purchases made on https://www.fomometer.ai and https://app.fomometer.ai, including all subdomains (hereinafter “FOMOmeter”, “we”, “us”, “our”, “site”, “platform”). By accessing or using FOMOmeter, you agree to this Refund Policy. All payments and orders are processed exclusively by Paddle.com, our authorized reseller and Merchant of Record. Refund requests must be directed to FOMOmeter via email at app@fomometer.ai. By completing a purchase, you acknowledge that Paddle’s Terms and Conditions and Privacy Policy apply.
Activation and access. After payment, we send an access link to the email provided. Clicking this link constitutes activation of your access and immediate receipt of the purchased service. Once activated, no refunds are granted.
Consumer rights and cancellation period. If you are classified as a consumer under applicable law, you may request cancellation and refund within 14 calendar days of the original transaction, provided that (i) the access link has not been activated, and (ii) no access to FOMOmeter has been obtained. If you reside in the EEA or the UK, you acknowledge that the statutory right of withdrawal does not apply once digital content or services begin to be supplied following your explicit consent to immediate access.
Chargebacks and payment disputes. Initiating chargebacks without first contacting FOMOmeter via app@fomometer.ai is a violation of this Policy. Customers must first attempt resolution with FOMOmeter and cooperate during dispute procedures. Excessive chargebacks may result in suspension or termination of access.
Fraudulent activity and abuse. FOMOmeter and Paddle reserve the right to deny refunds if fraud, misuse, refund manipulation, or abuse is suspected. Such cases may result in permanent blacklisting.
Refund method. All approved refunds are processed only through the original payment method. Paddle manages all refund transactions. No alternative methods or direct refunds are provided.
Changes to Refund Policy. FOMOmeter reserves the right to update this Refund Policy at any time without prior notice. Continued use after modifications constitutes acceptance.
Pricing and Plans. All pricing, plans, and service specifications are listed in the Pricing section of the website and are provided for informational purposes only. FOMOmeter reserves the right to change, modify, add, or remove any features, plans, or prices at any time, at its sole discretion, without prior notice. Actual pricing and specifications may differ from those displayed on the website. FOMOmeter bears no responsibility for such differences and is under no obligation to notify users of any changes.
Finality of digital services. Access to digital content and services is considered fully delivered at the moment of activation. No partial refunds or prorated credits will be issued for unused periods or features.
Email delivery. Delivery of access emails or magic links may be delayed or blocked by spam filters, security systems, or third-party issues. Such delays do not constitute grounds for a refund as long as a valid activation link is provided.
Goodwill. FOMOmeter is under no obligation to provide goodwill or discretionary refunds outside the scope of this Policy.

13. Complaint Policy

FOMOmeter adheres to a complaint-handling policy with an expected response period of thirty calendar days from receipt.
Users are encouraged to resolve disagreements through our internal complaint process before resorting to public statements or legal action. Violations of these Terms or abusive behavior may lead to account termination and legal actions.
Complaints are accepted only via email at app@fomometer.ai.

14. Entire Agreement and Severability

These Terms of Use constitute the entire agreement between you and FOMOmeter concerning the use of FOMOmeter. Waiver of any provision is not considered a continuing or future waiver. If any provision is found unenforceable, the remaining provisions remain effective.
If any provision is deemed unenforceable or invalid, it shall be amended to reflect the intentions of the parties, with the remaining provisions remaining fully effective.

References in these Terms to services, applications, dashboards, analytics, insights, features, or sections of the website or platform shall be interpreted broadly to include any substantially similar or successor functionality, whether existing now or introduced in the future.

15. Force Majeure

FOMOmeter bears no liability for failure or delays in fulfilling obligations due to circumstances beyond its reasonable control, including natural disasters, internet disruptions, cyberattacks, pandemics, power outages, strikes, civil unrest, or government actions.

16. Third-party Services, Links, and Integrations

FOMOmeter may contain links to, integrate with, or rely on third-party websites, tools, services, data sources, open-source libraries, or SDKs, including but not limited to the following and any other current or future integrations necessary for FOMOmeter’s operation:

By making a purchase, you agree that the transaction is processed by Paddle and subject to their Terms and Conditions and Privacy Policy.

FOMOmeter assumes no responsibility for the content, availability, accuracy, data handling, policies, or practices of any third-party services. Using third-party services is at your own risk and subject to their terms.

17. Payments and Billing via Paddle

All payments for subscriptions or purchases on FOMOmeter are processed by our authorized reseller and Merchant of Record, Paddle.com.

Paddle.com is the seller for all orders placed through FOMOmeter. By making a purchase, you agree that the transaction is processed by Paddle and subject to their:

You represent and warrant that you are not (i) located in, organized under the laws of, or a resident of any country or territory subject to comprehensive U.S., U.K., or EU sanctions or embargoes, or (ii) a denied, debarred, or restricted party under applicable export control or sanctions laws. You agree to comply at all times with applicable export control and sanctions laws and regulations, including those of the U.S., U.K., and EU, in connection with your access to and use of FOMOmeter.
